The Environmental Foundation Ltd. v. The Land Commissioner and two others

The Environmental Foundation Limited (EFL) instituted this case in the Public Interest against the lease of state land in Kandalama village, to a private company that intended to construct a hotel on said land. The company gave no notification to the public of the proposal by publishing it in the Gazette, and hence, provided no opportunity for objections. Considering the matters with regard to the environmental impact of the proposed lease of state land adjacent to the Kandalama tank, the Court of Appeal issued an order to restrain the Land Commissioner from executing the lease of the said land without complying with Regulation 21 (2) of the Regulations under Sec.96 of the Crowns Land Ordinance.
